Step 2: Due to over pricing, the home stays on the market. Meanwhile, the home down the street sells for $250,000. After 6 months, the seller decides the agent hasn’t done their job and fires them.

Step 3: The homeowner decides to go with another listing agent and lists the home for $250,000. The current CMA shows the home is now only worth $225,000. Still bringing up the rear, in terms of being competitively priced, the home is now racing against the rate of depreciation in order to sell. Another 6 months goes by and nary an offer is brought.

Step 4: In another rotation of agents, the new listing agent is dismissed and a replacement is brought in for a fresh start. Agent after agent have unsuccessfully tried to get this home sold. This time, the seller lists the home at $225,000. Even that will not save his bacon, as the depreciating market has dropped his home value to around $200,000.

Step 5: I think you get the idea here….

Pricing is pivotal, and since the homeowner thought he knew better than the Realtor, his home lost a lot of value and took over a year to sell. In February 2009 the median time on the Boise real estate market was 109 days on Zillow.

Many of the reports of fraud being reported are outrageous, says Lawrence Wasden, Idaho’s Attorney General. The Attorney Generals office rapidly sought out and received three settlements and filed two lawsuits on behalf of citizens and victims. It also hired a part-time house counselor to work with Boise real estate owners to facilitate loan modifications and to reverse, postpone or cancel foreclosures. They even went as far as publishing and handing out a foreclosure guide.

Collecting restitution for the Idaho taxpayers, Wasdens office brought in 7.4 million dollars, is an important function for the Attorney Generals office, and average of $12.14 for every tax dollar spent on funding for Consumer Affairs. In addition to that, Wasden and company gathered another $5.9 million dollars in civil penalties, fees and fines for the Idaho tax payers, which is the greatest haul to date for that classification. Back in 1998, the AG’s office negotiated a settlement with the tobacco industry which netted Idahoans a $31 million windfall for the year of 2009. Idaho has taken in an otherwise unseen $254 million as a result over the years.

While only costing the state of Idaho $833,000 and bringing in a total of $44 million, the consumer affairs operations are a very positive force for citizens in general, but specifically for those who own Boise real estate. The department was very effective in the broad range of topics it worked in last year. It prosecuted and settled consumer protection cases with Eli Lilly & Co., other pharmaceutical manufacturers and several businesses.
